The FIPB is a high powered committee comprising the Principal Secretary to the Prime Minister (Chairman), Finance Secretary and Commerce Secretary, and is located at the Ministry of Industry.</p> <p>The FIPB is empowered to consider proposals for investment in India, which do not fall within the parameters of the existing policy.<br /> The functions of the Board include:</p> <p>(a)&nbsp;&nbsp;&nbsp;&nbsp; Expeditious clearance of proposals;</p> <p>&nbsp;(b)&nbsp;&nbsp;&nbsp; Establishment of contacts with and inviting select international companies for investment in the country in appropriate ventures and to periodically review the implementation of the projects cleared;</p> <p>&nbsp;(c)&nbsp;&nbsp;&nbsp; The Board&rsquo;s programmes of investment include a variety of activities such as marketing, designing and export promotion, energy conservation, technology upgradation and modernization, infrastructure development, better utilization of raw materials and natural resources and substantial increase in employment.</p> <p>The Indian Government has allowed foreign investment in the areas of transport, communications, electronics, energy, oil and gas exploration, chemicals, fertilizers, biotechnology, telecommunication, civil aviation, industrial, agricultural and electrical machinery.</p> <p><strong><em>Changing role of FIPB</em></strong><strong> </strong></p> <p>The Government is keen to gradually reduce the quantum of projects being referred to the FIPB and instead ensure that the bulk of foreign investment proposals are approved automatically by the RBI.&nbsp; The aim is to bring only selected large or sensitive projects for clearance to the FIPB.&nbsp; The role of FIPB is being altered from merely issuing clearances to carrying out policy reviews and promotion.</p> <p>The effort now being made is to ensure firstly, that proposals already in the pipeline are quickly cleared and secondly that step should be taken to attract investment in selected thrust areas of the economy.&nbsp; The FIPB may thus become a more proactive institution in terms of trying to seek out foreign investment rather than just approving projects.</p> <p><strong>Reserve Bank of India (RBI)</strong><strong> </strong></p> <p>RBI was established on April 1, 1935 in accordance with the provisions of the Reserve Bank of India Act, 1934 having Central Office at Mumbai since inception Originally it was privately owned, since nationalization in 1949 fully owned by the Government of India <br /> The Preamble prescribes the objective as:<br /> <em>&quot;&hellip;to regulate the issue of Bank Notes and keeping of reserves with<br /> a view to securing monetary stability in India and generally to operate the currency and credit system of the country to its advantage.&quot;</em></p> <p><strong>&nbsp;</strong></p> <p><strong>Legal Framework</strong><br /> Umbrella Acts </p> <ul> <li>Reserve Bank of India Act, 1934: governs the Reserve Bank functions </li> <li>Banking Regulation Act, 1949: governs the financial sector</li> </ul> <p>Acts governing specific functions </p> <ul> <li>Public Debt Act, 1944/Government Securities Act (Proposed): Governs government debt market </li> <li>Securities Contract (Regulation) Act, 1956: Regulates government securities market </li> <li>Indian Coinage Act, 1906:Governs currency and coins </li> <li>Foreign Exchange Regulation Act, 1973/Foreign Exchange Management Act, 1999: Governs foreign exchange market </li> </ul> <p>Acts governing Banking Operations</p> <ul> <li>Companies Act, 1956:Governs banks as companies </li> <li>Banking Companies (Acquisition and Transfer of Undertakings) Act, 1970/1980: Relates to nationalisation of banks </li> <li>Bankers&rsquo; Books Evidence Act </li> <li>Banking Secrecy Act </li> <li>Negotiable Instruments Act, 1881</li> </ul> <p>Acts governing Individual Institutions</p> <ul> <li>State Bank of India Act, 1954 </li> <li>Industrial Development Bank of India </li> <li>Industrial Finance Corporation of India </li> <li>National Bank for Agriculture and Rural Development Act </li> <li>National Housing Bank Act </li> <li>Deposit Insurance and Credit Guarantee Corporation Act</li> </ul> <p>Monetary Authority: </p> <ul> <li>Formulates, implements and monitors the monetary policy. </li> <li>Objective: maintaining price stability and ensuring adequate flow of credit to productive sectors. </li> </ul> <p>Regulator and supervisor of the financial system: </p> <ul> <li>Prescribes broad parameters of banking operations within which the country&rsquo;s banking and financial system functions.<br /> Objective: maintain public confidence in the system, protect depositors&rsquo; interest and provide cost-effective banking services to the public. </li> </ul> <p>Manager of Exchange Control: </p> <ul> <li>Manages the Foreign Exchange Management Act, 1999. </li> <li>Objective: to facilitate external trade and payment and promote orderly development and maintenance of foreign exchange market in India.</li> </ul> <p>Issuer of currency: <br /> &#61623;&nbsp; Issues and exchanges or destroys currency and coins not fit for circulation. <br /> &#61623;&nbsp; Objective: to give the public adequate quantity of supplies of currency notes and coins and in good quality. <br /> Developmental role <br /> &#61623;&nbsp; Performs a wide range of promotional functions to support national objectives. <br /> Related Functions <strong></strong><br /> &#61623;&nbsp; <strong>Banker to the Government</strong>: performs merchant banking function for the central and the state governments; also acts as their banker. <strong></strong><br /> &#61623;&nbsp; <strong>Banker to banks</strong>: maintains banking accounts of all scheduled banks. </p> <p><strong>Security Exchange Board of India (SEBI)</strong><strong> </strong></p> <p>The Securities and Exchange Board of India, which was set up as an administrative body in April 1988 was given statutory status on 30.1.1992 by promulgation of SEBI Ordinance, which has since become an Act of Parliament. The Securities and Exchange Board of India (SEBI) with its over 15 years of existence has made considerable dent in the capital market through its various development and regulation of the capital market.</p> <p>After it became a statutory body, SEBI restructured and rationalised its organization in line with its expanded range and scope of activities. It has divided its activities in to five operational departments, each headed by an executive director. </p> <p>The objective of setting up SEBI is to protect the interest of investors in securities and to promote the development and to regulate the security market. SEBI has mainly three objectives or duties cast upon it by the Act-</p> <p>(a)&nbsp;&nbsp;&nbsp;&nbsp; to protect the interests of investors in securities.<br /> (b)&nbsp;&nbsp;&nbsp;&nbsp; to promote the development of securities market.<br /> (c)&nbsp;&nbsp;&nbsp;&nbsp; to regulate the securities market. </p> <p><strong>Registrar of Companies (RoC)</strong><strong> </strong></p> <p>Registrars of Companies (ROC) appointed under Section 609 of the Companies Act covering the various States and Union Territories are vested with the primary duty of registering companies floated in the respective states and the Union Territories and ensuring that such companies comply with statutory requirements under the Act. These offices function as registry of records, relating to the companies registered with them, which are available for inspection by members of public on payment of the prescribed fee. The Central Government exercises administrative control over these offices through the respective Regional Directors.</p> <p><strong><u>&nbsp;</u></strong></p> <p><strong>Director General of Foreign Trade (DGFT)</strong><strong> </strong></p> <p>The office of DGFT is responsible for the execution for the execution of the import Export Policy of the Government of India. This office has various subordinates all over India. DGFT is responsible for issue of Import Export Code Number, grant of Import-Export Licence, issue of Advance release orders, custom clearance permit and other matter specified in the Export Import
